Welcome to Abby AI. These Terms of Service govern your use of Abby AI Limited’s mobile application, website, and related services (collectively, the "Services"). By accessing or using Abby AI, you agree to comply with and be bound by these Terms.

If you do not agree with these Terms, do not use Abby AI.

1. Who We Are

Abby AI Limited ("we," "us," or "our") is a UK-based company providing AI-powered solutions for the direct selling industry. Our registered office is:

2. Eligibility

To use Abby AI, you must be at least 13 years old (or the minimum age required by your country). You must have the legal capacity to enter into this agreement. You must not be prohibited from using our Services under applicable laws.

If you are using Abby AI on behalf of a company, you confirm that you have authority to accept these Terms on their behalf.

3. Your Account

You may need to create an account to access certain features of Abby AI. You agree to provide accurate, up-to-date information during registration. You must maintain the confidentiality of your account credentials. You must notify us immediately if you suspect unauthorised access.

We reserve the right to suspend or terminate your account if we detect fraudulent, abusive, or illegal activity.

4. Permitted Uses

You agree to use Abby AI only for lawful purposes, such as running your direct selling business, creating AI-assisted content for your business, and collaborating with teams and leaders in direct selling.

You must not use Abby AI for fraud, spamming, or unauthorized marketing. You must not reverse-engineer, decompile, or modify any part of Abby AI. You must not share, resell, or exploit our Services without permission.

Any violation of these Terms may result in account suspension or legal action.

5. Payments and Subscriptions

Some features of Abby AI require a paid subscription. By subscribing, you agree that payments are processed via Apple Pay, Google Pay, or Stripe. Subscriptions automatically renew unless canceled.

You may cancel your subscription via

  • iOS: Settings > Apple ID > Subscriptions
  • Android: Google Play Store > Subscriptions

6. Refund Policy

We offer refunds under the following conditions:

Apple App Store Purchases
For purchases made via the Apple App Store, refunds are handled by Apple. To request a refund:

  1. Visit Apple's Refund Page at https://reportaproblem.apple.com/
  2. Sign in with your Apple ID
  3. Select Abby AI and follow the refund request steps

Google Play Store Purchases
For purchases made via the Google Play Store, refunds follow Google’s policy:

  1. Visit Google Play’s Refund Page at https://support.google.com/googleplay/answer/2479637?hl=en
  2. Sign in to your Google account
  3. Select Abby AI and follow the refund request steps

Direct Purchases via Stripe or Website

For purchases made directly through our app or Stripe, you may request a refund within 14 days of purchase, subject to review. To request a refund:

  1. Email team@abby-ai.com with
    • Your name and account email
    • Purchase date and payment details
    • Reason for the refund request
  2. Our team will review your request within 5 business days and notify you of the outcome

Refunds are not guaranteed and are subject to our review. We may issue partial refunds based on usage and eligibility. Refunds, if approved, will be processed within 7 to 10 business days.

7. Intellectual Property

All content, AI-generated materials, trademarks, and software within Abby AI belong to us or our licensors. You may not copy, distribute, or sell any part of our Services without written permission. You may not claim ownership over AI-generated content created using Abby AI.

We grant you a limited, revocable license to use Abby AI only as intended.

8. AI Content and Limitations

Abby AI uses AI to generate content for direct selling businesses. You understand and agree that AI-generated content may contain errors or biases. You are responsible for reviewing AI-generated content before using it. Abby AI is not liable for misuse or inaccuracies in AI-generated content.

If you find any inappropriate AI output, report it to team@abby-ai.com.

9. Privacy and Data Protection

Your use of Abby AI is subject to our Privacy Policy at [Insert Privacy Policy Link], which explains what data we collect, how we use and protect your data, and your rights under UK GDPR.

10. Limitation of Liability

To the extent permitted by law, Abby AI is not liable for business losses resulting from AI-generated content, data breaches or security incidents beyond our reasonable control, or indirect, incidental, or consequential damages.

Our total liability is limited to the amount you paid for the Service in the last 12 months.

11. Governing Law and Dispute Resolution

These Terms are governed by UK law. Any disputes shall be resolved through:

  1. Informal Negotiation: Contact team@abby-ai.com to resolve the issue
  2. Binding Arbitration: If unresolved, disputes will be settled by arbitration in the UK
  3. Small Claims Court: If eligible, you may file in small claims court in your jurisdiction

By using Abby AI, you waive the right to a jury trial or class action lawsuit.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you via in-app notifications or email if applicable.

Continued use of Abby AI after updates means you accept the new Terms.
